This page (together with our Privacy & Cookies Policy) sets out the terms and conditions (“Website Terms”) on which we, Food2You Swanage Ltd (“we”, “our” or “Food2You”), provide access to our website food2you.co.uk and any Food2You mobile application through which you order products (together, the “Website”).
Please read these Website Terms carefully before accessing or using the Website or placing any orders. By accessing the Website or placing an order (whether now or in the future), you agree to be legally bound by these Website Terms. If you do not accept these Website Terms, you must not use the Website or place any orders through it.
We reserve the right to amend these Website Terms at any time by updating this page. The version in force at the time you place an order will apply. These Website Terms are available in English only.
Use of your personal information submitted via the Website is governed by our Privacy Notice and Cookies Policy.
For the avoidance of doubt, references to the “Website” in these Website Terms include any current or future version of food2you.co.uk and any Food2You mobile application, whether accessed via desktop, mobile device, or any other platform.

The legal contract for the supply of Products is between you and the Business. Food2You acts as an agent for the Business in relation to Product sales only.
1.4 Delivery Services
Businesses listed on the Website do not charge delivery fees.
Food2You provides delivery services using independent drivers. Any delivery fee shown at checkout is set and charged by Food2You. A significant proportion of the delivery fee is paid to the driver completing the delivery. The remaining proportion contributes towards Food2You’s operational costs, including driver organisation, technology, insurance, customer support, and platform maintenance.
In respect of delivery services and delivery fees, Food2You acts as principal and not as agent for the Business.

By placing an Order, you confirm that:
• you are legally capable of entering into a binding contract; and
• you are at least 18 years old.
If you have allergies or specific dietary requirements, you must contact the relevant Business directly before placing an Order. Food2You does not guarantee the accuracy or completeness of allergen or dietary information displayed on the Website.
Orders containing age-restricted Products (including alcohol) may only be purchased by persons aged 18 or over. Valid photographic proof of age may be required on delivery.
Food2You reserves the right to refuse delivery of age-restricted Products where:
• valid proof of age is not provided;
• the recipient appears to be under the age of 18;
• the recipient appears intoxicated; or
• delivery would otherwise breach applicable law or licensing conditions.
No refund will be provided for age-restricted Products where delivery is refused due to failure to meet the above requirements.

5. PRICE AND PAYMENT
5.1 Product prices and platform commission
Prices displayed on the Website may be higher than prices offered in-store or through other sales channels. This reflects a commission payable by the Business to Food2You for providing the ordering platform, payment processing, driver coordination, technology infrastructure, and operational support.
Each Business confirms that it has reviewed and approved its Website prices and is satisfied that those prices represent fair value.
Food2You does not guarantee price parity with in-store pricing.

6. CUSTOMER CARE
Food2You is not responsible for the preparation, quality, safety, ingredients, allergen information, accuracy, or pricing of Products. These matters remain the responsibility of the relevant Business.
Food2You is responsible for the delivery service only, including the reasonable organisation and completion of delivery to the address provided at checkout.
Any issues with Products or delivery should be reported as soon as reasonably possible and, in any event, within 24 hours of placing the Order, to enable investigation and resolution. This reporting timeframe does not affect your statutory consumer rights.

Estimated delivery times are provided for guidance only and are not guaranteed. Delivery times may be affected by factors outside Food2You’s reasonable control, including traffic conditions, weather, order volume, and availability of drivers.
Food2You does not guarantee that Products will meet individual preferences or dietary requirements and does not guarantee the availability of any Product.
10. LIABILITY
• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation; or
• any liability that cannot be excluded or limited under applicable law.
Food2You is not liable for the preparation, quality, safety, ingredients, allergen content, or description of Products supplied by Businesses.
Subject to the above, Food2You’s total liability to you arising out of or in connection with an Order or delivery service shall not exceed the value of the affected Order or £100 (whichever is lower).
Food2You shall not be liable for losses arising from delivery refusal of age-restricted Products where such refusal is required by law or these Website Terms.

Food2You may delay, refuse, or cancel delivery of alcohol where required to comply with licensing conditions or applicable law. No refund will be provided where refusal is lawful and compliant with these Website Terms.
